These Terms govern your use of the Spry mobility workouts app, published by Vibe Coding Basics LLC. They include important terms for accounts, subscriptions, ads, purchases, and medical disclaimers.

By installing, accessing, or using Spry, you agree to these Terms.

Who we are

Spry is a mobility workouts mobile app published by Vibe Coding Basics LLC ("Spry," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of the Spry app, accounts, subscriptions, purchases, ads, and related services. By installing, accessing, or using Spry, you agree to these Terms. If you do not agree, do not use the app.

Not medical advice

Spry provides general fitness and mobility content for informational and educational purposes only. Nothing in the app is medical advice, diagnosis, or treatment.

Spry is not a substitute for advice from a qualified physician, physical therapist, or other licensed healthcare professional. Do not use Spry to diagnose or treat any health problem or disease, and do not disregard, avoid, or delay obtaining medical advice from a healthcare professional because of something you saw or did in the app.

Always consult a qualified healthcare professional before starting a new exercise routine, particularly if you are pregnant, recovering from an injury or surgery, have any chronic condition (including but not limited to heart, blood-pressure, joint, back, or neurological conditions), are taking medication, or have any other reason to believe exercise may be unsafe for you.

If you experience pain, dizziness, shortness of breath, lightheadedness, chest discomfort, or any other concerning symptoms during or after using Spry, stop immediately and seek medical attention. In an emergency, call your local emergency number.

Assumption of risk

Physical exercise carries inherent risks, including muscle strain, sprains, falls, and other injuries. By using Spry, you voluntarily assume all risks associated with performing the exercises and routines shown in the app. You are solely responsible for evaluating whether a given movement is safe and appropriate for you, for using proper form, for selecting an appropriate environment, and for stopping if anything feels wrong. To the maximum extent permitted by law, you release Vibe Coding Basics LLC from any and all claims, liabilities, demands, damages, costs, and expenses arising out of or related to your use of the app or any injury you may sustain.

Eligibility

Spry is intended for adults. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the app. By using Spry you represent that you meet this requirement and that you are physically able to perform exercise of the kind shown in the app.

Your account and device

Spry may require or allow an account for certain features. Account sign-in is provided through Firebase Authentication and may include Google Sign-In. You are responsible for choosing the correct Google account, maintaining access to your sign-in method, and keeping your device secure.

You are responsible for activity that occurs through your account unless caused by our failure to use reasonable security measures. If you believe your account has been compromised, contact us at vibecodingbasics@gmail.com.

You can delete your Spry account in the app by opening Spry, going to Settings or Account, choosing Delete account, and confirming the prompts. You can also request deletion through Spry Account & Data Deletion.

License to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Spry on a device you own or control, solely for your personal, non-commercial use. This license is provided through the relevant app store and is also subject to that store's rules. We retain all rights not expressly granted.

Acceptable use

  • Do not copy, modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it.
  • Do not resell, sublicense, rent, lease, or commercially exploit the app or its content.
  • Do not use the app to violate any law or any third party's rights.
  • Do not interfere with the operation of the app, attempt to disable or circumvent advertising, or attempt to access systems or data you are not authorized to access.
  • Do not use automated means (bots, scrapers) to access the app.

Paid features, subscriptions, and restore purchase

Spry may offer paid features, auto-renewing subscriptions, or other in-app purchases through Google Play. Prices, billing periods, renewal terms, free trials, and cancellation rules are shown in the app and in Google Play before purchase. By purchasing, you authorize Google Play to charge the selected payment method according to the terms shown at checkout.

We use RevenueCat to validate purchases, manage entitlement access, and support restore-purchase functionality. A successful purchase or restore may unlock paid features for the account or device associated with the entitlement.

Google Play handles billing, subscription management, cancellation, refunds, and payment support for Google Play purchases. You can manage or cancel a Google Play subscription in the Spry app where a manage-subscription link is available, in the Google Play Store under Payments & subscriptions, or at play.google.com/store/account/subscriptions.

Uninstalling Spry, deleting your Spry account, or losing access to paid app features does not automatically cancel an active Google Play subscription. Cancel through Google Play if you do not want future renewal charges.

Advertising

Spry is supported in part by advertising served by Google AdMob. By using the app you understand that ads may be displayed and that Google AdMob may process certain device and advertising data as described in the Spry Privacy Policy. Where required by law, Spry uses Google's User Messaging Platform (UMP) to ask for and manage consent choices. You can manage ad personalization through your device settings and, where available, through privacy choices in the app. We do not endorse or accept responsibility for the products or services advertised by third parties.

Intellectual property

The Spry app, including its name, logo, content, exercise routines, illustrations, copy, design, and software, is owned by Vibe Coding Basics LLC or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Except for the limited license above, nothing in these Terms transfers any intellectual-property right to you.

Third-party services

Spry integrates with third-party services, including Firebase Authentication, Google Sign-In, Google Play, RevenueCat, Google AdMob, and Google UMP. Your use of those services is governed by their own terms and privacy policies. We are not responsible for outages, policy changes, content moderation decisions, billing decisions, refund decisions, or other actions taken by those third parties.

Google Play terms

If you obtained Spry from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the app or for any claims relating to the app, except to the extent required by Google Play's own terms or applicable law.

If Spry is made available through another app store or distribution platform, that store's terms may also apply to your download, billing, updates, refunds, and use of Spry.

Disclaimer of warranties

SPRY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECT WILL BE CORRECTED. WE MAKE NO WARRANTY THAT THE EXERCISES OR CONTENT IN SPRY WILL PRODUCE ANY PARTICULAR FITNESS, HEALTH, OR PHYSICAL RESULT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE CODING BASICS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST DATA, OR PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OF SPRY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold harmless Vibe Coding Basics LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use or misuse of Spry, (b) your violation of these Terms, or (c) your violation of any applicable law or any third party's rights.

Termination

You may stop using Spry and uninstall it at any time. You may also delete your account in the app or request deletion through /spry/account-deletion. Account deletion does not cancel an active Google Play subscription; subscriptions must be canceled through Google Play.

We may suspend or terminate your access to Spry at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the app. Sections that by their nature should survive termination (including the "Not medical advice," "Assumption of risk," "Paid features, subscriptions, and restore purchase," "Disclaimer of warranties," "Limitation of liability," "Indemnification," and "Governing law" sections) will survive.

Changes to the app and these Terms

We may update Spry and these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated through an in-app notice or app-store update notes where reasonable. Continued use of Spry after an update means you accept the revised Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The parties will first try in good faith to resolve any dispute through direct discussion. If a dispute cannot be resolved informally within 30 days, the courts located in Los Angeles County, California have exclusive jurisdiction over any resulting litigation, and the parties consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your country of residence.

Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms, together with the Spry Privacy Policy and any rules of the app store from which you obtained the app, form the entire agreement between you and Vibe Coding Basics LLC regarding Spry, and supersede any prior or contemporaneous understandings on the same subject.
